The NBA legend Tells Court He Felt No Fear of the Racing Body in Antitrust Trial

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Financial Stakes and a Will to Win

Jordan shared operational insights of his racing venture, saying he put in $40m of his personal wealth into the Cup Series operation co-founded with partner Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan stated during testimony. “I was a new person, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”

Central Issue: Charter Agreements and Contract Pressure

The heart of the case involves the end of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other professional sports with independent franchises, like the Charlotte Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.

Jordan testified for about sixty minutes and left the court to pandemonium, with fans and media vying for a view or a picture of the global icon.

Leading the Legal Charge

Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is unlawful to maintain excessive control.

At issue for Jordan and Heather Gibbs, who testified before Jordan, are events from September 2024. She recounted a frantic and emotional period where the racing circuit informed teams they must sign a contract extension. This agreement consists of over a hundred pages detailing pay for chartered teams and a guaranteed entry in every race.

A Refusal to Sign

Jordan explained that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that 112-page package and take the issue to court. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin approached Nascar about possible changes or extension options. Nascar wasn’t talking, according to his testimony.

Ultimately, the pushback against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Success.

“Denny convinced me getting a third driver boosted our odds of winning,” he testified, sharing that he bought a third charter late in 2024 for $28m amid the legal dispute. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, submitted in a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.

She said, the team founder first attempted to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, I have 30.”
